“(Company”, “we”, “us”, or “our”). The Site and all the materials available on the Site are the property of us and are protected by copyright, trademark, and other intellectual property laws. By using the Site, and/or purchasing something from Company, you agree to be bound by these Terms and Conditions and to use the Site in accordance with them, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Company. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service. You further agree that by accessing or using any part of the Site, you engage in our service as a client and are also bound by those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the Site including, without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to them. We reserve the right to change these Terms and Conditions or to impose new conditions on use of the Site from time to time, in which case we will post the revised Terms and Conditions on the Site. By continuing to use the Site after we post such changes, you accept the Terms and Conditions as modified.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this service. You may not use our services for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws in your jurisdiction, including but not limited to copyright laws. You must not transmit any worms, viruses or any other technological features of a destructive nature. A breach or violation of any of the Terms and Conditions will result in an immediate termination of your services and potential legal action should such violation cause harm to the Site or Company.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Site, use of the Site, access to the Site, or any contact on the Site through which the service is provided without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 -ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
Company is not responsible if information made available on the Site is not accurate, complete, or current. The material on the Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on the Site is at your own risk. The Site may contain certain historical information. Historical information, by definition, is not current and is provided for your reference only.
SECTION 4 - MODIFICATIONS TO THE SERVICES AND PRICES
Prices for our services are subject to change without notice. We reserve the right at any time to modify or discontinue a product without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the product.
SECTION 5 - PRODUCTS OR SERVICES (if applicable)
Certain products or services may be available exclusively online through Emily Freeman Coaching, Inc. These products or services may have limited quantities. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
SECTION 6 - REGISTRATION
To access certain features of the Site, we may ask you to provide certain demographic information including your gender, year of birth, zip code and country. In addition, if you elect to sign up for a particular feature of the Site, you may also be asked to register with us on the form provided. Such registration may require you to provide personally identifiable information such as your name and email address. You agree to provide true, accurate, current and complete information about yourself as prompted by the Site’s registration form. If we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site or any portion thereof. Our use of any personally identifiable information you provide to you as part of the registration process is governed by the terms of our Privacy Policy.We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). In the future, we may also offer new services and/or features through the website including the release of new tools and resources. Such new features and/or services shall also be subject to these Terms and Conditions.

In no case shall Emily Freeman Coaching, Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Site or any products procured using the Site, or for any other claim related in any way to your use of the Site or any product including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Site or any content or product posted, transmitted, or otherwise made available via the Site, even if advised of such possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, our liability in such states or jurisdictions shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Emily Freeman Coaching, Inc. and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our services or when you cease using the Site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly, we may deny you access to our Site (or any part thereof).

ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on the Site constitutes the entire agreement and understanding between you and us and govern your use of the Site, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions, previously known as “Terms of Service”.). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

GOVERNING LAW
These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Arizona, United States of America.

CHANGES TO TERMS AND CONDITIONS
You can review the most current version of the Terms and Conditions by asking President and CEO Emily Freeman for a copy. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to this policy. It is your responsibility to check with President and CEO Emily Freeman for changes. Your continued use of or access to the Site following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

NATURE OF COACHING
Coaching is not a substitute for any kind of counseling, mental health care, physical or other type of health care, treatment of severe mental, emotional, or psychiatric problems, substance abuse treatment, psychotherapy, or any other therapy. Coach is not a medical, financial, legal, or other professional, and Client is strongly encouraged to consult a licensed legal/medical/financial/other professional when it comes to certain questions to ensure you are receiving a comprehensive answer from that particular licensed professional.

STATEMENTS OF INTENT AND RELEASE AND WAIVER OF LIABILITY
Client releases, waives, acquits, holds harmless, and discharges Coach and agents, successors, assigns, personal representatives, executors, heirs, and complies from all liabilities and every claim, suit, action, demand, or right to compensation for damages Client may claim to have or that Client may have rising out of actions, omissions, or commissions taken by Client or by Coach as a result of the advice given by Coach, or otherwise resulting from the coaching relationships contemplated hereunder. Client further declares and represents that no promise, inducement, or agreement not herein expressed has been made to Client to enter into this Agreement. The Agreement and release made pursuant to this paragraph shall bind Client's heirs, executors, personal repos, successors, assigns, and agents. Client agrees that Coach may provide Client with other sources of information, including but not limited to links to websites, printed materials, or audio, and Client understands that Coach makes no warranties as to accuracy or reliability of such information, including their privacy policies. Client will not hold Coach liable for any incident or consequential damages resulting from use or affiliation with such materials. Client acknowledges that Coach is not providing Services as a licensed health care provider and does not engage in patient diagnosis or the practice of medicine. Similarly, Coach is not a psychotherapist and does not purport to offer mental health care advice to Client. Information and coaching provided by Coach does not constitute legal, financial, tax, medical, psychiatric, psychological, or other types of evaluation, advice, or representation and is not intended to substitute for such evaluation, advice or representation. Client agrees to independently assess any decisions, actions or inactions resulting from or relating to the coaching experience based on medical, psychological, psychiatric, legal, tax, financial, or other advice as applicable. Client understands that results are not guaranteed and that it is the sole responsibility of the Client to make his/her own opinions, choices and decisions as well as to determine appropriateness and effectiveness of Services rendered as well as competency of the Coach.
SECTION 22 - LIVE GROUP COACHING RULES
The rules that must be followed include:
a) Solicited feedback only. Feedback will only be given when asked for, i.e.; you can say, "Are you open to feedback?", before giving yours.
b) Be bold. Attracting your dream woman requires boldness. This is an opportunity to learn how to advocate for yourself. The more you are willing to open up and share, the faster you will see results.
c) Be accountable. Stay on top of the assignments as best as possible. Commit to yourself and the container over the duration of the program. You only get as much from this program as you are willing to give.
d) No hate speech or bullying. Make sure everyone feels safe. Bullying of any kind isn't allowed, and degrading comments about things like race, religion, culture, sexual orientation, gender or identity will not be tolerated.
e) Be honest and compassionate. This is a safe space for all group members to share their experiences. Healthy debates are natural, and challenge is necessary for growth, but kindness is required.
f) No promotions or spam. Give more than you take in this group. Self-promotion, spam, and irrelevant links aren't allowed.
SECTION 23 - RESPONSIBILITIES OF BOTH PARTIES
CLIENT:
Client responsibilities are as follows:
a) Client is responsible for his/her physical and mental well-being. Coaching can trigger emotional, mental, and physical effects. Client agrees to take full responsibility of his/her self-care in the emotional, mental, physical, and spiritual areas of his/her life.
b) Responsibility for choices and decisions that arise from or are related to the coaching program. Client is responsible for any decisions made while in coaching with me.
c) Client is responsible for doing homework, being dedicated to the work, completing modules, and being committed to the process. Coaching programs can be transformative, and clients who are very committed to the process typically see the best results.
d) Client agrees to maintain confidentiality of other group members, including names and any other information they may disclose in the private paid group or on VIP calls.
e) Client agrees to adhere to all group rules (section 23).
COACH:
Coach responsibilities are as follows:
a) Reserve the right to refuse Services for any reason.
b) Being on time, providing supportive listening, adhering to cancellation policy, and upholding all paid group rules for VIP group or individual sessions (section 23), etc.
SECTION 24 - DISCLOSURE FOR TEACHING OR MARKETING PURPOSES FOR CONTRACTED PAID CLIENTS
Contracted paid Client is aware that Coach may share Client's stories, anonymously, for teaching or marketing purposes whether it is with another Client, members of the private Community, newsletter subscribers, or social media followers. The Client will remain completely anonymous unless explicit, written permission is given by the Client that his/her name and certain specific details may be used.
SECTION 25 - INFORMED CONSENT
Client understands that coaching is for the purpose of understanding difficulties in obtaining a relationship and being able to create future relationships, and Client gives informed consent to engage in coaching services and for Coach to assist in coaching for the aforementioned purpose(s). Client agrees that he/she is using coaching services entirely at his/her own risk.
SECTION 26 - TESTIMONIALS
Coach will always ask permission prior to using any testimonial a contracted paid Client gives of the Coach's services. Coach will confirm with Client whether the Client's full name can be used. Client shall specify how he/she would like to be quoted. Client reserves the right to refuse to allow his/her testimonial to be used. All permissions, non permissions for testimonial use shall be made in writing. Once permission is granted, Coach reserves the right to use testimonial indefinitely unless a certain date is specified by Client.
SECTION 27 - WARRANTY
Coaching is provided "as is" without any warranty of any kind, express or implied. Client warrants that any decisions, actions, or inaction he/she makes and consequences thereof, are his/her own and at his/her own risk, and that Client takes full responsibility for all emotional, mental, behavioral, and physical risks.
SECTION 28 - GUARANTEES
Emily Freeman Coaching, Inc. makes no guarantees as to the results of its Coaching services.
