Article 5 - PROGRAM TERMS & PARTICIPATION REQUIREMENTS

Your participation in the Program begins upon receipt of your first payment and continues for the duration specified. To maximize your investment and results, you are expected to:

• Attend live coaching calls when possible (replays available for missed sessions)

• Complete all assigned exercises, worksheets, and action items

• Participate actively and authentically in group discussions

• Maintain regular engagement with the community platform

• Implement coaching recommendations and feedback

• Communicate any challenges or concerns promptly to Coach

Important Notice:

Results are not guaranteed and depend entirely on your commitment, participation, and implementation of the strategies taught. Individual results may vary significantly based on personal circumstances, effort, and other factors beyond Coach's control.

Article 6 - INTELLECTUAL PROPERTY & LIMITATION OF USE

All materials, concepts, tools, frameworks, language, and content shared by Coach within any program — including but not limited to live sessions, written resources, proprietary methods, teachings, and recorded content — are the sole intellectual property of Emily Freeman Coaching, Inc.

Client agrees that these materials are provided for personal use only and may not be copied, taught, repurposed, sold, or shared in any way for commercial or professional purposes — including use in any coaching, consulting, therapy, content creation, or business-related context — without prior written permission from Coach.

Client further agrees not to claim ownership or authorship over any part of the Feminine in Love curriculum, language, or practices.

Violation of this clause may result in immediate removal from the program without refund and may be subject to further legal action as deemed necessary by Coach.

Article 7 - USER CONTRIBUTIONS & COMMUNITY PARTICIPATION

You may share personal experiences, insights, and feedback within the Program community. By doing so, you grant Coach a perpetual, worldwide, royalty-free license to use your contributions for educational, marketing, or promotional purposes in an anonymous or aggregated manner, unless you provide explicit written permission for attributed use.

You retain ownership of your personal stories and experiences but acknowledge that general insights and transformations may be shared by Coach to help other clients, always maintaining your privacy and anonymity unless otherwise agreed.

Article 8 - COMMUNITY GUIDELINES & CONDUCT

To maintain a safe, supportive environment for all participants, you agree to abide by the following community guidelines:

A) Confidentiality:

Maintain strict confidentiality regarding other participants' personal information, stories, and experiences shared within the Program.

B) Respectful Feedback:

Offer advice or feedback only when specifically requested and do so with compassion and respect.

C) Authentic Participation:

Show up with courage, vulnerability, and compassion for yourself and others.

D) Zero Tolerance Policy:

No hate speech, discrimination, bullying, harassment, or disrespectful behavior of any kind.

E) No Solicitation:

Refrain from self-promotion, business solicitation, spam, or promoting competing services.

F) Professional Boundaries:

Respect Coach's time and expertise by directing questions to appropriate channels.

Violation of these guidelines may result in warnings, temporary suspension, or permanent removal from the Program without refund.

Article 9 - CONFIDENTIALITY & PRIVACY

Coach agrees to maintain the confidentiality of your personal information and any private communications, except as required by law or when you pose a danger to yourself or others. All personal information shared during coaching sessions will be kept confidential and used solely for the purpose of providing coaching services.

Coach may share anonymous, aggregated information about client outcomes for educational or marketing purposes but will never reveal personally identifiable information without your explicit written consent.

Article 10 - MARKETING & EDUCATIONAL USE DISCLOSURE

Coach may use anonymous client stories, testimonials, and case studies for educational or marketing purposes to help other potential clients understand the value and outcomes of the Program. All such uses will protect your identity and privacy unless you provide explicit written permission for attributed use.

If you prefer to opt out of any anonymous sharing, you may do so by providing written notice to Coach at any time during or after the Program.

Article 11 - TESTIMONIALS & SUCCESS STORIES

Any testimonials, reviews, or success stories will only be used with your explicit written permission. You are under no obligation to provide testimonials, and your participation in the Program is not contingent upon providing feedback or testimonials.

If you choose to provide a testimonial, you grant Coach permission to use it in marketing materials, website content, and promotional activities in perpetuity unless you revoke permission in writing.

Article 12 - INFORMED CONSENT & LIMITATIONS
Important Disclaimer:

Coaching is not therapy, counseling, or medical treatment. The Program focuses on personal development, mindset work, and relationship coaching for educational purposes only. Coach is not a licensed therapist, psychologist, or medical professional.

By participating, you acknowledge that:

• You are mentally and emotionally capable of participating

• You will seek appropriate professional help for any mental health concerns

• You participate entirely at your own risk

• Coach cannot and does not guarantee specific outcomes or results

• You are responsible for your own decisions and actions
  

If you are receiving therapy or medical treatment, you agree to inform your healthcare providers about your participation in this Program.

Article 13 - PARTICIPANT OBLIGATIONS & RESPONSIBILITIES

As a Program participant, you agree to:

A) Account Security:

Keep your login credentials secure and confidential. You are responsible for all activities under your account.

B) Accurate Information:

Provide truthful, accurate, and complete information during registration and throughout the Program.

C) Active Participation:

Engage authentically and consistently with Program materials and community.

D) Technical Requirements:

Ensure you have reliable internet connection and appropriate technology to participate in live calls and access materials.

E) Communication:

Communicate promptly with Coach regarding any issues, concerns, or changes in your circumstances.

F) Compliance:

Follow all Program guidelines, community rules, and terms of service.

Article 14 - ACCEPTABLE USE POLICY

You agree to use the Program and Website only for lawful purposes and in accordance with this Agreement. Prohibited uses include:

• Any illegal activities or violation of applicable laws

• Harassment, threats, or intimidation of other participants

• Sharing or distributing malicious software or harmful content

• Attempting to gain unauthorized access to Program systems or materials

• Impersonating Coach or other participants

• Engaging in any activity that could damage Coach's reputation or business

Article 15 - NO GUARANTEES & ASSUMPTION OF RISK

While Coach is committed to providing high-quality coaching and support, individual results vary significantly based on numerous factors including but not limited to personal circumstances, commitment level, implementation of strategies, and external factors beyond Coach's control.

Coach makes no guarantees regarding:

• Specific outcomes or results

• Timeline for achieving goals

• Compatibility with your unique situation

• Resolution of personal or relationship challenges
  

You acknowledge that personal development and relationship coaching involve inherent risks and that you assume full responsibility for your participation and any consequences thereof.

Article 16 - SECURITY, DATA PROTECTION & LOSS

You are responsible for maintaining the security of your account and any data you access through the Program. Coach implements reasonable security measures but cannot guarantee complete security of data transmission or storage.

Coach is not liable for:

• Data loss due to technical failures

• Unauthorized access to your account due to compromised credentials

• Interruption of service due to technical issues

• Loss of access to materials due to platform changes

It is your responsibility to download and save any materials you wish to retain beyond the Program period.

Article 17 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Coach, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your participation in the Program

• Your violation of this Agreement

• Your violation of any rights of third parties

• Your use or misuse of Program materials

• Any content you submit or share within the Program
  

Article 18 - ANTI-SPAM POLICY

Unsolicited commercial communications, spam, or promotional activities are strictly prohibited within the Program community or to other participants. This includes but is not limited to:

• Promoting your own business or services

• Sharing affiliate links or promotional codes

• Soliciting participants for other programs or services

• Sending unsolicited private messages for commercial purposes

Violations may result in immediate termination from the Program without refund.

Article 19 - MODIFICATION OF TERMS

Coach reserves the right to modify, update, or change these terms at any time without prior notice. All changes will be posted on the Website and will be effective immediately upon posting. Your continued participation in the Program after any modifications constitutes your acceptance of the new terms.

It is your responsibility to review these terms periodically for changes. If you do not agree to any modifications, your sole remedy is to discontinue participation in the Program.

Article 20 - TERMINATION & CONSEQUENCES
Termination by Coach:

Coach may terminate your access to the Program immediately and without notice if you violate any terms of this Agreement, engage in inappropriate behavior, or for any reason that Coach deems necessary to protect the integrity of the Program or other participants.

Termination by Participant:

You may choose to discontinue participation at any time; however, no refunds will be provided under any circumstances.

Consequences of Termination:

Upon termination, you will immediately lose access to all Program materials, community, and future sessions. You must cease all use of Program materials and delete any downloaded content.

Article 21 - LIMITATION OF LIABILITY

Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, regardless of the legal theory and whether Coach has been advised of the possibility of such damages.

Article 22 - DISPUTE RESOLUTION & GENERAL PROVISIONS

A) Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

B) Arbitration

Any disputes arising from this Agreement shall be resolved through binding arbitration in Scottsdale, Arizona, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

C) Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.

D) Waiver

The failure of Coach to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.

E) Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the subject matter herein.

F) Force Majeure

Coach shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, or technical failures.

G) Electronic Communications

You consent to receive electronic communications from Coach regarding the Program, and you agree that such communications satisfy any legal requirement for written notice.

H) Assignment

Coach may assign this Agreement to any third party without your consent. You may not assign your rights or obligations under this Agreement without Coach's written consent.
